This document (and any document mentioned below) establishes the general conditions of use of this website (www.parisfrip.com) by the "user", this term designating any Internet user browsing the site in any capacity whatsoever (buyer, professional, natural person acting in his personal name or on behalf of a legal entity, Internet user not registered on the site, etc.); as well as the conditions applicable to purchases and orders made through it, between :
- on the one hand, any individual or legal entity wishing to make a purchase via the site, hereinafter referred to as "the buyer" or "the customer"
- and on the other hand, SAS Parisfrip, hereinafter referred to as "the seller"
The site is the exclusive property of Parisfrip, as are all related rights.
Any reproduction, in whole or in part, is systematically subject to the authorization of the owners. However, hypertext links to the site are authorized without specific request. Moreover, this does not prevent you from using this website to copy information necessary for your order or your identification information.
The site may also contain hyperlinks to third party sites. These links are provided simply as additional information. Parisfrip has no control over the sites to which these links refer and declines all responsibility for access, content or use of these sites, as well as for any damage that may result from consulting the information on these sites. As soon as the user is redirected to a third party site, the conditions of use of the site in question apply in place of these General Conditions, which cease to apply.
The decision to click on these links is the full responsibility of the user.
If the User accesses an illegal or harmful third-party site through the Site, the User shall immediately notify Parisfrip so that the link to the offending site can be removed without delay.
1 - Scope of the Terms and Conditions of Sale and Use
These General Terms and Conditions of Sale (hereinafter referred to as the "GTC") apply solely to orders placed on the www.parisfrip.com website for one or more items invoiced and delivered in Metropolitan France, French overseas departments and territories, and abroad where applicable.
By placing an order on the website, the customer accepts and agrees to be bound by these terms and conditions of sale, which the customer expressly acknowledges and agrees to waive, in particular, any contradictory document that may be unenforceable against Parisfrip Inc.
These Terms and Conditions are valid as of February 1, 2020. Parisfrip reserves the right to modify the content of these Terms and Conditions at any time, without any obligation to notify customers. The new Terms and Conditions will come into effect on the date of their publication on the www.parisfrip.com website.
2 - Presentation of the products
The items offered for sale on this site are described in a description mentioning their essential characteristics within the meaning of Article L. 111-1 of the Consumer Code. The photographs illustrating the articles are represented as faithfully as possible, but have no contractual value. The clothes or accessories present on the photos with the product described are not available for sale.
The articles on sale on the aforementioned site comply with the regulations in force in France at the time of their release. Parisfrip cannot be held responsible for any failure to comply with the laws of a third country in which the items are delivered, used or resold. It is the customer's sole responsibility to verify that the characteristics of the products match the commercial laws of the country of destination.
Most of the items presented on the site are SINGLE SAMPLES, because they are second hand clothes and accessories. All the products are in very good condition, the light marks of wear which are detected at the time of the control of clothing are mentioned in the description product. As far as the size or the material of the product is concerned, an estimation is made when the garment does not have any information on these points (no label).
Within the framework of the sales, the offers of products are valid as long as they are visible on the site, within the limit of the available stocks and in the countries distributed by the service providers La Poste or Mondial Relay. In case of exceptional malfunction in the management of stocks and in the event of unavailability of products after placing the order of the ''buyer'', the ''seller'' will notify the customer by mail of the delivery of a partial order or the cancellation of his order. In the event that the bank account of the "buyer" would have been debited, the "seller" will initiate a procedure for immediate refund. The customer's account will be credited again.
The delay will depend on the type of bank card owned: 3 to 8 days for an immediate debit and end of month for a deferred debit.
3 - Prices of the articles
All the prices of the articles are indicated in euros.
The items are invoiced on the basis of the rates in force at the time of the registration of the orders. They remain the property of Parisfrip until full payment has been received, i.e., when Parisfrip collects the price of the order. The price is payable in full and in one payment at the time the order is placed and will be debited immediately from the customer's account before the ordered item(s) are shipped.
The price indicated on the product sheets includes the price of the products and their maintenance.
Shipping costs, which include logistics, packaging and transportation costs, are added to the product's selling price at the last stage of the purchase. They depend on the delivery method chosen by the "buyer" and the weight of the package.
The price indicated in the order confirmation is the final price, expressed all taxes included and including VAT for France and the countries of the European Union. This price includes the price of the products, the cost of their maintenance, handling, packaging, transport and commissioning costs.
Any order placed on the site and delivered outside of France may be subject to possible taxes and customs duties that are imposed when the package reaches its destination.
These customs duties and taxes are the sole responsibility of the customer. Parisfrip is not required to verify and inform its customers of applicable customs duties and taxes, as customs policies vary from country to country. Consequently, customers are advised to check with the relevant authorities in their country.
4 - Ordering process
In order to access the site's ordering process, the customer must create an account by manually filling in the required fields of the registration form. The customer agrees to update the information provided to Parisfrip as soon as possible. The customer is solely responsible for the possible consequences of not updating this information. Opening an account is free, with no obligation to buy or sell on the site. The user must be over 18 years old and have full legal capacity to conclude a sale.
The user name and password will be strictly personal and confidential and the user must use them in a manner that maintains strict confidentiality.
The registered buyer will only be allowed to access the site using the username and password.
Any use of the site by means of these user names and passwords is deemed to have been made by the user himself.
In the event of use by a third party of his username and password, the user must immediately notify Parisfrip :

The user is responsible for the use of the site and for all actions taken on the site with his or her username and password, unless the use of his or her account was made after he or she was unsubscribed, or after notification to Parisfrip.
Automatic registration systems are considered as proof of the nature, content and date of the order.
Parisfrip will confirm the acceptance of the order to the customer at the email address provided by the customer. The sale will only be concluded once the order has been confirmed.
Parisfrip reserves the right to cancel any order placed in bad faith or for any other legitimate reason, and in particular if there is a dispute with the customer regarding the payment of a previous order.
The information given by the "buyer" when placing an order is binding. In case of error in the information given in the order form, (wording of the recipient's details etc ...), the seller can not be held responsible for the impossibility in which it could be to deliver the product. After payment on our secure server (see ''payment''), an acknowledgement of receipt is displayed. The acknowledgement confirms the registration of the buyer's order and informs the buyer that a confirmation email will be sent to him/her as soon as possible.
Parisfrip will only honor orders received on the website within the limits of available stock.
5 - Deletion of the Customer account
At the user's initiative
Each customer may request the deletion of their registration on the website by sending a request to Parisfrip:

Unsubscribing will result in the termination of the account.
This cancellation will take effect within thirty (30) working days from the date Parisfrip receives the request to cancel the subscription.
Parisfrip reserves the right to terminate the customer's account without prior notice or formalities in the event that the user fails to comply with its obligations under this agreement.
Termination of the customer's account will result in immediate unsubscription.
The user will be informed of the said termination by e-mail to the address he/she filled in at the time of registration.
Termination is without prejudice to any damages that may be claimed by Parisfrip as compensation for any damages suffered as a result of the User's alleged violations.
6 - Payment terms and security of payments
The price charged to the customer is the price indicated on the order confirmation sent by Parisfrip.
The price of the products is payable in cash on the day the order is placed.
Payments will be made through secure platforms: Paypal or Stripe
You can pay for your purchases on https://www.parisfrip.com by several methods
- either by credit cards: Visa, MasterCard, American Express and other blue cards. The payment is made on the secure bank servers of our partner STRIPE. This implies that no banking information concerning the "buyer" transits via the said site.
The payment by credit card is therefore perfectly secure; the order of the "buyer" will be recorded and validated upon acceptance of payment by the bank chosen by the latter.
- Via the secure Paypal platform:
By selecting this payment method, you will be directed to PayPal. Once you have entered the required information, you will be automatically redirected to our e-shop to complete your order.
With PayPal, the "buyer's" financial information is never shared with Parisfrip. In fact, PayPal encrypts and protects the buyer's credit card number. Payment is made online, and the buyer simply needs to enter his or her email address and password.
7 - Delivery method
After order confirmation, Parisfrip will deliver all items ordered by the buyer to the carrier within a maximum of 72 working hours. Parisfrip's carrier is committed to delivering the order to the address indicated by the "buyer" in the order form.
When you add a product to your shopping cart, the carrier selected by default is usually Mondial Relay, which is the least expensive. If you wish to be delivered by La Poste, you can choose this carrier during the "delivery" stage of your order.
Deliveries in the European Union
- by Mondial Relay :
Only for the following countries: Belgium, Luxembourg, Spain, Germany, Netherlands, Italy, Portugal and Austria.
The delivery of the parcel is carried out either in a relay point or at home, with an average delivery time of 3 to 6 working days according to the destinations, as from the assumption of responsibility of the parcel by the partner network.
- by La Poste :
Deliveries are made either by Colissimo Europe Domicile without signature or with signature, or by Colissimo Europe Point Retrait with an indicative delivery time from D+3.
Deliveries outside the European Union
- by International Postal Services:
They are carried out by the international postal services via Colissimo with delivery against signature of the recipient, with an average time of sending from 5 to 8 days from the deposit in the post office.
The customer agrees to pay all import taxes, customs duties, value-added tax and any other taxes due under the laws of the country where the order is received. Parisfrip will not be held responsible if the customer does not pay all taxes.
Your package is shipped at your own risk, but special care is taken to ensure proper packaging. Boxes are properly sized and your items are properly protected.
Delivery is FREE from 50 euros of purchase.
Delivery costs include preparation and packaging costs, as well as shipping costs. The preparation costs are fixed, while the shipping costs vary according to the total weight of the package and its destination.
The costs will be indicated to you when you place your order.
For the shipments, our partners are La Poste Colissimo and Mondial Relay.

8 - Return policy
Under the right of withdrawal, defined in Article L.221-18 of the Consumer Code, you have a period of 14 calendar days following receipt of your order, to cancel the order of any product purchased on the site www.parisfrip.com. You do not have to justify your reasons, nor to pay any penalty.
If the item has not yet been shipped, Parisfrip will immediately take into account the decision to cancel and the buyer will be reimbursed within a maximum of fourteen (14) days from the date of the decision to cancel.
After this period, as stipulated in article L.221-18 of the French Consumer Code, the products can only be reimbursed within the framework of the mandatory legal provisions regarding conformity and hidden defects, as stipulated in articles L.211-1 and following of the French Consumer Code and articles 1641 and following of the French Civil Code.
Any request for return which does not fall within the framework of the legal provisions mentioned above cannot be satisfied.
Notification of withdrawal
To cancel your order under your right of withdrawal, you must notify your intention to withdraw :
- either by sending a letter before the end of the return date, mentioning the name of the item concerned, to the following address :

For this purpose, you can use the model of retraction form located in appendix of the General Conditions of Sale.
Any request for return after the deadline can not be satisfied.

All returned items must be perfectly intact.
You have a period of 14 calendar days to return the product purchased. This period runs from the communication of your decision to withdraw.
For any order delivered outside of metropolitan France, the return costs are also charged to the buyer.
Parisfrip will reimburse the full purchase price of the item(s), excluding shipping costs, within 14 days of being informed of your decision to withdraw.
However, Parisfrip reserves the right to defer the refund until the item(s) have been recovered, or until proof of shipment has been received, whichever comes first.
All returned items must be perfectly intact.
You will then receive an email to notify you of the refund. This means that the refund request has been validated with our payment intermediaries Stripe or Paypal.
It may take a few days before you receive the payment in your bank account, depending on the processing time of your bank.
9 - Legal and contractual guarantees
The legal guarantees
The seller is responsible for the defects of conformity of the good to the contract under the conditions of article L. 211-4 and following of the code of consumption and for the hidden defects of the sold thing under the conditions envisaged in articles 1641 and following of the civil code. When he acts in legal guarantee of conformity, the consumer :
- has a period of two years from the date of delivery of the goods to act ;
- may choose between repairing or replacing the goods, subject to the cost conditions provided for in Article L. 211-9 of the Consumer Code;
- is exempted from proving the existence of the lack of conformity of the good during the six months following the delivery of the good,
- is informed that this legal guarantee of conformity applies independently of any commercial guarantee that may have been subscribed.
- is informed that he can decide to implement the guarantee against the hidden defects of the sold thing under the terms of the article 1641 of the civil code, and that in this hypothesis, he can choose between the resolution of the sale or a reduction of the price according to the article 1644 of the civil code.
We do our best to satisfy you. We are responsible for the good execution of the present general conditions, nevertheless our responsibility could not be committed because of a fortuitous occurence, of a case of absolute necessity, of the occurrence of a fact imputable to the customer or of an unforeseeable and insurmountable fact of a third party to the contract, or of any inconvenience, unforeseeable and insurmountable damage inherent in the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses, or finally because of the non-conformity of the product to foreign legislation in the event of delivery in a country other than France.
Maintenance or updating of the site
Parisfrip undertakes to do its utmost to ensure the proper functioning of the site and its accessibility by the user, but it is bound only by an obligation of means concerning the continuity of access to the site.
Parisfrip does not guarantee the durability or performance of the site.
Parisfrip reserves the right to suspend access to the site, temporarily or permanently, without notice.
Parisfrip shall not be liable for any temporary or permanent interruption of the site and shall not be entitled to any compensation from the user.
The user acknowledges that he/she uses the site as provided at his/her own risk and with full knowledge of the facts.
Furthermore, the www.parisfrip.com website contains hyperlinks to other websites. Parisfrip cannot be held responsible for the content of these websites if they contravene the legal and regulatory provisions in force.
The photographs and illustrations accompanying the articles on the website are not contractual and Parisfrip cannot be held responsible for them.
Any unforeseeable, irresistible event external to the parties, such as (but not limited to) acts of war or terrorism, criminal acts, riots, natural or industrial disasters, explosions, legal demands and other provisions of a legal or regulatory nature that restrict the exercise of Parisfrip's activity, disruptions of electronic communication networks beyond Parisfrip's control, etc., shall be considered as force majeure.
In the event of force majeure, Parisfrip may be forced to suspend the site.
The effects of the contract will then be suspended and will resume after the end of the case of force majeure for the duration of the contract that remained at the time of the suspension.
10 - Applicable Law and Dispute Resolution
The present conditions are subject to French law.
In case of dispute on the substance or on the form, the French courts will be only competent.
Parisfrip cannot be held responsible for any damages of any kind, whether material or immaterial, that may result from the misuse of the products sold.
Parisfrip's liability is in any case limited to the amount of the order and cannot be held responsible for simple errors or omissions that may have occurred despite all precautions taken in the presentation of the products. In case of difficulties in the application of the present contract, "the buyer" has the possibility, before any legal action, to seek an amicable solution, he can in particular resort to a conventional mediation, in particular near the Commission of the mediation of consumption (article L 534-7 of the Code of consumption) or with any alternative mode of settlement of the disputes (conciliation, for example) in the event of contesting.
It is reminded that the search for an amicable solution does not interrupt the "short period" of the legal guarantee, nor the duration of the contractual guarantee. It is reminded that as a general rule and subject to the appreciation of the Courts, the respect of the provisions of the present contract relating to the contractual guarantee supposes that the "buyer" honors his financial commitments towards the "seller".
Complaints or disputes will always be received with attention and benevolence, good faith being always presumed in the one who takes the trouble to expose his situations. In the event of a dispute, the customer should first contact Parisfrip to obtain an amicable solution.
For any claim, the customer must contact Parisfrip's Customer Service Department, whose address and telephone number are listed in article 11 "Customer Service".
If no agreement is reached after this first contact, the customer may send a registered letter to Parisfrip with acknowledgement of receipt. In this letter, the customer must
Explain the problem and the purpose of the request;
Indicate their contact information, customer number, order reference and attach all necessary documents (copies of purchase order, invoice, etc.).
Parisfrip undertakes to process the claim within a maximum of 15 calendar days from the date of receipt.
In any case, the client has the right to take the matter directly to the competent court.

12 - Protection of personal data
PARISFRIP undertakes not to infringe on the privacy of the users of the website and the confidentiality of the information provided.
The personal information collected for the purposes of distance selling is mandatory, as this information is essential for the processing and delivery of orders, the establishment of invoices and warranty contracts. Failure to provide this information will result in the non-validation of the order.
PARISFRIP is the sole recipient of this data.
In accordance with the law "Informatiques et Libertés" of January 6, 1978 modified in 2004, the customer has the right to access, modify, rectify and delete data concerning him/her, which he/she can exercise with PARISFRIP (article 34 of the law of January 6, 1978).
